Legal authority: This warranty is to the effect that the artist promises they have the full power and legal capacity to sign the contract and perform its obligations. For a band, this means every member is bound by the agreement.
No conflicting agreements: According to this warranty the artist guarantees that entering into the contract will not breach or conflict with any prior agreements they have with other parties, such as a record label, manager, or agency.
Originality and clearances:
Original works: The artist warrants that any original material they perform is their sole creation. Hence no co-creation.
Third-party content: For any cover songs or sampled material, the artist guarantees that they have obtained all necessary licenses and permissions from the copyright holders and paid any required fees.
No infringement: As per this warranty, the artist promises that their performance, including the use of their stage name and the musical compositions, will not violate or infringe upon the copyrights, trademarks, publicity rights, or any other legal rights of a third party in Cameroon and abroad.
No libel or defamation: This warranty is to the effect that the artist guarantees that their performance does not contain any material that is libelous, defamatory, or invades another's privacy as this may lead to legal action.
Professional conduct: assurances of good and professional behaviour during the performance of the contract is also a warranty required of artists.
What happens if an artist breaches a warranty in Cameroon?
