The exclusive and assignable legal right, given to the originator for a fixed number of years, to print, publish, perform, film, or record literary, artistic, or musical material.
GENERAL SUBJECT MATTER OF PROTECTION
The author of any original literary or artistic work of the mind shall enjoy, by mere fact of its creation, an exclusive incorporeal property right in the work which shall be enforceable against all persons. This right shall include attributes of an intellectual and moral nature as well as attributes of an economic nature as determined by law.
The protection shall begin with the creation of the work even if he work is not fixed on a material medium.
WORKS SUBJECT MATTER OF PROTECTION
Works as a subject matter of protection shall apply to literary and artistic works constituting original creations of the mind in the literary, artistic and scientific field such as:
- Works expressed in writing, including computer programs;
- Lectures, addresses, sermons and other works composed of words and expressed orally;
- Musical works, whether or not accompanied by words;
- Dramatic and dramatico-musical works;
- Choreographic works and mimed works;
- Audio-visual works etc.
Protection shall be independent of the mode or form of expression, of the quality and of the purpose of the work.
DERIVATIVE WORKS AND COLLECTION AS A SUBJECT MATTER OF PROTECTION
The following shall be protected as works:
- Translations, adaptations, arrangements and other transformations of works and of expressions of folklore;
- Collection of works, of expressions of folklore or of simple facts or data, such as encyclopaedias, anthologies and databases, whether reproduced on a medium that may be processed by a machine or in any other form, which, by reason of the selection, coordination or arrangement of their contents, constitute creations of the mind.
SUBJECT MATTER NOT PROTECTED
The protection by copyright shall not extend:
- To official texts of a legislative, administrative or judicial nature or to the official translations thereof;
- To news of the day;
- To simple facts and data.
