What is Alimony in Cameroon Divorce Law?

Alimony, or spousal support/maintenance in Cameroon Divorce Law constitutes a court-ordered financial obligation requiring one spouse to provide financial support to the other following legal separation or divorce. Its primary purpose is to prevent a spouse with lower earning capacity from suffering a marked deterioration in their standard of living, whilst addressing the economic disparities that frequently arise where one spouse has sacrificed their career in furtherance of the marriage.

Can a Wife be Ordered to provide Alimony to the Husband in a Divorce Process?

A wife may be ordered to pay alimony to her husband following divorce, as spousal support is gender-neutral and based solely on financial need. The higher-earning spouse, regardless of gender, may be required to support the other in maintaining a comparable standard of living.

Key Factors for Post-Divorce Alimony in Cameroon Divorce Proceedings

Income Disparity: In circumstances where the wife's income significantly exceeds that of the husband.

Financial Dependence: Where the husband was financially dependent upon the wife during the subsistence of the marriage.

Length of Marriage: The longer the duration of the marriage, the greater the likelihood that a court will order the payment of alimony upon its dissolution.

Earning Capacity: The court takes into consideration the future earning capacity of the dependent spouse, as well as any career sacrifices made by that spouse in the course of the marriage.

Important Considerations:

Final Judgment: Alimony is usually decided before or during the final divorce decree. Generally, it cannot be requested for the first time after the divorce is finalized unless the court previously reserved the right to do so.
