FAMILY AND MARRIAGE LAW IN CAMEROON

In Cameroon, a divorce agreement represents the critical turning point in a contested divorce when both spouses reach agreement on the terms of their separation including child custody, maintenance, and the division of matrimonial property effectively converting the case into a consent judgment. This shift typically occurs when one or both parties recognize the significant financial cost, emotional toll, and uncertainty associated with a full trial, and decide instead to seek a more amicable resolution.

When the Turning Point Occurs

After Failed Conciliation: The High Court in Cameroon mandates an attempt at reconciliation or mediation in line with Rule 7.6 of the Family Procedure Rules 2010 and Section 6(1) of the Matrimonial Causes Act 1973. When this fails and the case enters the adversarial "contested" phase, parties may still reach an agreement, stopping further litigation.

During Discovery: As legal counsel uncovers financial realities or proves fault (such as adultery or cruelty), the parties may find it strategic to enter a settlement agreement to avoid a prolonged, public battle alongside further exposing family secrets in open court.

Alternative Dispute Resolution (ADR): The agreement often results from mediation efforts where a neutral party helps spouses reach a mutually acceptable agreement, which is then formalized and presented before the judge for a consent divorce decision.

Legal Significance of the Turning Point of a Divorce Agreement

Change of Process: The divorce matter will move from an adversarial, evidence-driven, high-cost process to an accelerated "uncontested" process.

Consent Judgment/Decree: Instead of a contentious judgment based on fault, the judge grants a "consent judgment" (often initially a decree nisi), which is based on the negotiated agreement between the parties before the judge with the help of their respective attorney.

Finality: A divorce agreement is a more practical step to allow parties bring to finality certain disputed issues like property division, custody over children, alimony etc.

Ultimately, this agreement represents the transition from a "fault-based" contest to a voluntary dissolution, sparing the court from making final determinations on the details of the breakdown which in some cases may not create negative sentiments between the spouses.
