BANKING AND FINANCE LAW IN CAMEROON

Payment systems in Cameroon are sets of instruments, procedures, and rules including card-based, electronic transfers, and digital wallets used to transfer funds between participants, typically involving payers, payees, and financial intermediaries. They enable secure, efficient, and increasingly instant electronic transactions, streamlining the flow of money in the Cameroon economy.

MEANS OF PAYMENT UNDER THE CAMEROON PAYMENT SYSTEM

Means of payment under the Cameroon payment system are the various methods, instruments, or vehicles used to transfer value for goods, services, or debt settlement, including cash, bank transfers, credit/debit cards, and digital wallets. These methods can be categorized as traditional (cash, checks) or electronic, with options expanding to include automated clearing house (ACH) transfers.

Common Means of Payment in Cameroon

Cash: Physical currency (notes and coins) considered legal tender, often used for small, immediate transactions in Cameroon.

Bank Transfers/Wire Transfers: A direct transfer of funds from the payer’s bank account to the payee’s, often used for larger payments or international transactions in Cameroon.

Credit Cards: Enables purchasing on credit, allowing the user to pay back the bank later, often with rewards in Cameroon.

Debit Cards: Deducts funds directly from the user's bank account instantly in Cameroon, offering a way to pay without debt.

Digital Wallets/Mobile Payments: Apps like MTN MOMO, ORANGE MONEY, that store payment methods and allow contactless transactions via phone or online.

Checks/Bank Drafts: Written orders to a bank to transfer funds from the payer’s account to the payee in Cameroon.

Anyone who fraudulently accesses or remains in all or part of an automated data processing system or a payment system is punishable by one (1) to two (2) years' imprisonment and a fine of 3,000,000 to 5,000,000 CFA francs, or by one of these penalties alone.

Any person whose fraudulent access or remaining in the system results in the deletion or modification of data contained in the system, or in the alteration of the system's operation, is punishable by two (2) to four (4) years' imprisonment and a fine of 5,000,000 to 10,000,000 CFA francs, or by one of these penalties alone.

Anyone who manipulates input data, programs, terminal commands, or output data, or who misuses computer services, whether on-site or remotely, to disrupt or interfere with the operation of an automated data processing system or a payment system, is liable to imprisonment for three (3) to five (5) years and a fine of 20,000,000 to 30,000,000 CFA francs, or to one of these penalties alone.

The act of fraudulently introducing, deleting, or modifying data in an automated data processing system is punishable by imprisonment for three (3) to five (5) years and a fine of 20,000,000 to 30,000,000 CFA francs, or to one of these penalties alone.

Participation in a group formed or an agreement established with a view to preparing, characterized by one or more material acts, one or more of the

offenses provided for in Articles 274 to 276 of the regulations is punishable by the penalties provided for the offense itself or for the most severely punished offense.
